1. About this website

Welcome to guidedtalent.com (the "Site"). The Site is operated by Guided Employment Group Pty Ltd (ABN 54 618 169 350), trading as GuidedTalent ("GuidedTalent", "we", "us" or "our"), a specialist recruitment practice focused on Data, AI and adjacent technology roles, operating across permanent recruitment and labour hire / on-hire contracting.

By accessing, browsing or using the Site, you agree to be bound by these terms of use (the "Terms"). If you do not agree with the Terms, you must stop using the Site immediately.

We may review and change these Terms at any time by updating this page. Changes take effect from the date they are published. Your continued use of the Site after changes are published means you accept the updated Terms.

2. No fee to candidates; no guarantee of placement

The Site provides information about GuidedTalent’s recruitment services, current vacancies and market insights. Nothing on the Site, and no engagement with GuidedTalent, guarantees that a candidate will be placed in a role, or that a client will find a suitable candidate. Recruitment outcomes depend on many factors outside our control, including the decisions of clients and candidates.

GuidedTalent does not charge candidates for our recruitment services. If you are engaged by GuidedTalent as a candidate and placed with one of our paying clients, whether on a permanent, contract, or labour hire / on-hire basis, you will never be charged a fee for that placement - our fees are paid by the client, not the candidate. We will not knowingly advertise a role that does not exist or provide misleading information about a role.

If you have previously purchased a consultation or course through GuidedEmployment and are subsequently placed in a role by a GuidedTalent consultant, the fee you paid GuidedEmployment for that consultation or course will be refunded to you. 3. Using the Site

You may use the Site for its intended purpose - to learn about GuidedTalent’s services, browse vacancies, and submit your details as a candidate or client enquiry. You must not use the Site to:

• breach any other person’s privacy or legal rights, including by uploading personal information about someone else without their consent;
• defame, harass, threaten or offend any person;
• interfere with any other person’s use of the Site;
• transmit viruses, malicious code, or attempt to tamper with, hack or disrupt the Site or its underlying systems;
• send unsolicited or bulk communications through the Site; or
• use the Site to compete with GuidedTalent’s business, or to scrape, harvest or extract data from the Site for a competing purpose.

4. Accuracy of vacancy and candidate information

We take reasonable care to ensure information about roles and candidates published on or submitted through the Site is accurate and current, but we do not warrant that it is complete, accurate or up to date at all times. Vacancies may be filled, withdrawn or changed by a client without notice.

If you submit information to us (as a candidate or client), you confirm that it is true and accurate to the best of your knowledge, and that you have the right to share it with us.

5. Intellectual property

The Site and its content - including text, graphics, logos, design elements and the GuidedTalent brand - are owned by or licensed to Guided Employment Group Pty Ltd and are protected by copyright and other intellectual property laws. We grant you a non-exclusive, non-transferable, revocable licence to access and use the Site for its intended personal or business purpose.

You must not reproduce, republish, distribute, modify or create derivative works from any part of the Site or its content without our prior written consent, except as reasonably necessary to view, save or print pages for your own personal or business use in dealing with GuidedTalent.

6. Privacy

Any personal information you provide through the Site is handled in accordance with our Privacy Policy, available on the Site, which also explains our use of cookies.

7. Links to other websites

The Site may contain links to third-party websites, including client career pages or job boards. We do not control, endorse or take responsibility for the content, accuracy or practices of any linked website, and including a link does not imply our endorsement of it.

8. Disclaimer and liability

Nothing in these Terms limits or excludes any guarantee, warranty, representation or condition implied or imposed by law (including the Australian Consumer Law) that cannot lawfully be limited or excluded.

Subject to that, the Site and its content are provided "as is" and "as available", without warranty of any kind. To the maximum extent permitted by law, GuidedTalent (and its officers, employees, contractors and agents) is not liable for any loss or damage arising from or in connection with your use of, or inability to use, the Site, including as a result of inaccurate, incomplete or out-of-date information, interruptions, errors, or unauthorised access to the Site.

To the extent permitted by law, GuidedTalent’s total liability arising out of or in connection with the Site or these Terms is limited, at our option, to re-supplying the relevant service or the cost of having it re-supplied.

9. Indemnity

To the maximum extent permitted by law, you indemnify GuidedTalent against any loss, damage, cost or expense arising from or in connection with your use of the Site or breach of these Terms.

10. Complaints

If you have a complaint about the Site or our services, please contact us using the details in section 12 so we can investigate. If your complaint relates to how we have handled your personal information and you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC).

11. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any dispute relating to these Terms is subject to the exclusive jurisdiction of the courts of New South Wales. If you access the Site from outside Australia, you are responsible for complying with the laws of your own jurisdiction.
